In-Person Pickups (Ocean Shores or within two hours of): Due the day of departure. Payment may be made in Cash at hand-off, or securely online through the kitten's official profile on www.NautilusPersians.com (accepting Major Credit/Debit cards, Apple Pay, and PayPal). Website checkout confirmation must be verified by the Seller prior to the physical release of the kitten.

Flight/Delivery Hand-Offs (Seller flying as Flight Nanny): The remaining balance must be paid securely online through the kitten's official profile on www.NautilusPersians.com a minimum of five (5) calendar days prior to departure. This ensures all funds are fully captured and cleared before airline travel is booked and the kitten's flight reservation is finalized.

Note: Personal checks are never accepted for final balances.

Section 1: Terms of Sale & Ownership Rules

• Indoor Only: This kitten is sold strictly as an indoor companion. It shall never be caged or tethered outside, nor allowed to roam freely outdoors.

• Breed Care Standards: Buyer understands that Persians are a high-maintenance breed requiring proper care, professional-level grooming, and optimal nutrition. By signing this contract, Buyer agrees to provide the absolute best care possible for said kitten to thrive.

• No Declawing: This kitten shall never be declawed under any circumstances.

• SpaySecure Non-Breeding Mandate: Buyer acknowledges that a material condition of this sale and transfer is that this pet is a non-breeding animal, and is sold in reliance on Buyer’s compliance to sterilize the pet before the deadline set forth in their SpaySecure agreement. Buyer agrees to sign and comply with all terms of the SpaySecure sterilization agreement, to not breed the pet, and to take the pet to a licensed veterinarian to be surgically sterilized before the specific SpaySecure deadline.

• Pedigree & Registration Papers: All official pedigree and registration applications will be provided to the Buyer only upon receipt of verification from SpaySecure or a veterinarian's certificate of altering. (Buyers of altered, retired adult cats will receive paperwork at the time of sale).

• No Unauthorized Rehoming: Under no circumstances can this Persian be resold or rehomed without the express permission of Nautilus Persians. This kitten may never be surrendered to an animal shelter, rescue group, humane society, or laboratory.

• First Right of Refusal: Buyer agrees to contact Seller should Buyer no longer wish to keep ownership of the kitten. Seller retains the absolute "first right of refusal," and the kitten must be offered back to the Seller at no other cost to the Seller beyond transportation expenses.

• Neglect or Mistreatment: If Seller has a good-faith belief that this kitten is being neglected, abused, abandoned, or maintained in conditions that seriously endanger its health or welfare, Seller may request the immediate voluntary surrender of the kitten. If Buyer refuses voluntary surrender, Seller reserves the right to pursue any and all remedies available under the laws of the State of Washington to protect the welfare of the kitten. If Buyer voluntarily surrenders the kitten pursuant to this Agreement, or if Seller prevails in a legal action to enforce this provision, Buyer agrees, to the fullest extent permitted by Washington law, to reimburse Seller for all reasonable costs incurred in recovering the kitten, including reasonable attorney's fees, court costs, transportation expenses, and veterinary expenses incurred as a result of the recovery. If registration has already been transferred, Buyer agrees to execute all documents necessary to transfer registration back to Seller within five (5) business days of surrender of the kitten.

Section 2: Health Guarantee & Medical Policies

Nautilus Persians (Amber & Daniel Scheffer) are NOT liable for any veterinary fees or costs and expenses directly and indirectly associated with this kitten after it has been released from Nautilus Persians Cattery. We do not breed any cats that have a known history of genetic defects. We are a PKD, FIV, FELV and parasite free cattery.

• Mandatory Initial Exam: To validate this Health Guarantee, the Buyer is required to have a licensed veterinarian examine the kitten within three (3) business days of physical receipt.

• Reporting Initial Life-Threatening Issues: If a life-threatening, untreatable congenital defect or illness is diagnosed within this initial 3-business-day window, Buyer must notify Seller immediately. Buyer must provide a written diagnostic report on official letterhead signed by the examining licensed veterinarian, including all supporting laboratory and diagnostic test results.

• Remedies for Initial Defects: If a life-threatening, untreatable congenital defect is verified within the initial 3-business-day window, Buyer may return the kitten to the Seller for a replacement kitten of equal value from a future litter when available. Seller agrees to cover the transportation/shipping costs for delivering the replacement kitten to the Buyer. Buyer explicitly acknowledges and agrees that under no circumstances will any cash, credit card, or financial refunds be issued, and Seller’s liability is strictly limited to an exchange. The kitten must be kept strictly isolated from other animals unless tested negative for FeLV/FIV at the Buyer's expense prior to return.

• Two-Year Genetic Guarantee: Seller guarantees the kitten against life-threatening, untreatable genetic defects for a period of two (2) years from the date of sale. If found to be medically deficient with a life-threatening, untreatable genetic problem within 2 years, it must be reported to the Seller immediately in writing on veterinary letterhead. Validating this clause requires a written second opinion from an independent, licensed veterinarian. Upon return of the kitten to Seller, a replacement kitten of equal value from a future litter will be provided when available, with transportation/shipping costs for the replacement kitten covered by the Seller. No financial refunds will be issued.

• Exclusion of Mild, Treatable, and Cosmetic Defects: This health guarantee covers ONLY life-threatening, untreatable conditions. Any mild, treatable, or cosmetic congenital, structural, or genetic variations unknown at the time of sale (including, but not limited to, minor malocclusions, shifting bites, narrow canines, umbilical hernias, cryptorchidism, or treatable infections) are explicitly excluded from this guarantee, and there will be no exchange, return, or financial compensation for them.

• Brachycephalic Syndrome: A goal of the SELLER in breeding is to select away from stenotic nares and elongated soft palates. These traits are very common in the Persian breed. However Persians and Himalayans are Brachycephalic- and for this reason the SELLER offers no guarantee or warranty against any disorder, infection, or anatomical trait that may result due to being a brachycephalic animal. This includes, but is not limited to: stenotic nares, elongated soft palates, jaw misalignments or dental malformations.

• Vaccination Requirements: The kitten will be vaccinated at a minimum for Feline Viral Rhinotracheitis, Feline Calicivirus, and Feline Panleukopenia before going home. A full vaccination record will be provided on or before delivery.

• Voiding Guarantee (FIP/FeLV Vaccines): Nautilus Persians does not recommend the FIP or FeLV vaccines for indoor Persians. If either vaccine is administered to this kitten, this entire health guarantee is automatically null and void.

• Feline Infectious Peritonitis (FIP) Policy: Buyer understands that FIP is caused by a random viral mutation of the common feline coronavirus, which no breeder can reliably predict or prevent. Seller/Breeder cannot and shall not be held liable if the kitten is diagnosed with FIP. Furthermore, Buyer acknowledges that FIP is now a treatable condition with timely veterinary intervention and medical supportive care, the cost of which is the sole responsibility of the Buyer.

• Stress-Induced Illness, PCR Panel Testing & Upper Respiratory Notice: Buyer acknowledges that transitioning to a new environment is a high-stress event for a kitten, regardless of how thoroughly socialized, confident, or outgoing the kitten may be. This environmental stress can temporarily depress the immune system, which may trigger standard, self-limiting rehoming reactions or the flare-up of common upper respiratory organisms including Feline Herpesvirus (FHV-1), Feline Calicivirus (FCV), or Mycoplasma species. Polymerase Chain Reaction (PCR) testing detects genetic material (DNA) and can indicate presence of these common microorganisms even in completely asymptomatic, healthy felines. Symptoms including, but not limited to, sneezing, watery eyes, runny nose, congestion, temporary diarrhea, vomiting, mild constipation, or a positive PCR test result for these endemic organisms are common to the rehoming process and are completely excluded from this health guarantee. These common "colds" or positive PCR test results do not constitute life-threatening, untreatable, or genetic defects, and any medical treatments or diagnostic testing for them are the sole financial responsibility of the Buyer.

Seller has full authority to revoke this contract at any time before kitten(s) leave the cattery. If seller revokes this contract, the deposit placed on kitten(s) becomes fully refundable.

Section 3: General Terms & Legal Provisions

Force Majeure & Delivery Disruptions: Seller shall not be held liable, in breach of contract, or financially responsible for any delays, alterations, or failures to deliver the kitten by a projected date due to causes beyond the Seller’s reasonable control. This includes, but is not limited to: severe weather conditions, airline cancellations, flight delays, airport closures, sudden illness or veterinary hold of the kitten, state or federal travel restrictions, pandemics, or other acts of God. In the event of such a disruption, the Seller will work in good faith with the Buyer to reschedule delivery at the earliest safe opportunity. If a mutually agreeable alternative delivery cannot be reached within thirty (30) calendar days of the original scheduled date, the Seller reserves the right to cancel the sale, and all funds paid by the Buyer (including the deposit) will be fully refunded, rendering this contract null and void.

Attorney's Fees: To the fullest extent permitted by Washington law, in any legal action arising out of this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs.

Governing Law & Venue: This Agreement shall be governed by the laws of the State of Washington. Any legal action arising under this Agreement shall be brought exclusively in the state or federal courts having jurisdiction over Grays Harbor County, Washington. Buyer explicitly and irrevocably consents to the personal jurisdiction of and venue in Grays Harbor County, Washington, for any legal proceedings arising from or related to this Agreement.

Severability: If any provision of this Agreement is found to be invalid or unenforceable by a court of law in the State of Washington, the remaining provisions shall remain in full force and effect.

Entire Agreement: This Agreement constitutes the entire understanding between Buyer and Seller regarding the sale of this kitten and supersedes all prior verbal or written discussions, representations, or agreements. Any amendment to this Agreement must be in writing and signed by both parties.
